Plain-English terms for using Twellie's buyer-side property reports, valuation logic, privacy controls, and support policies.

Notice to users: These Terms include a binding arbitration clause and a class-action waiver (Section 17). By accepting these Terms, you agree to resolve disputes with the Company through individual arbitration rather than in court. Please read those sections carefully.

1. About These Terms
1.1 Agreement
These Terms of Service (these "Terms") form a legally binding agreement between you ("you," "your," or "User") and EnglishAidol LLC, a Wyoming limited liability company that operates the Twellie service, together with its affiliates, successors, and assigns (collectively, the "Company," "we," "us," or "our"). Twellie is the name of the Service, not a separate contracting entity. The Company's legal-notice address is 5830 E 2nd St, Ste 7000 #29281, Casper, WY 82609, United States.
These Terms govern your access to and use of:
- The Twellie Website located at https://twellie.com, https://*.twellie.com, and any related domains we operate;
- The Twellie Mobile Applications for iOS and Android;
- The Twellie API (if and when made available to you);
- Any reports, analyses, summaries, scores, recommendations, or other outputs produced by our service ("Reports");
- All other software, services, content, features, documentation, and support we make available through any medium
(collectively, the "Service").
1.2 Acceptance
By creating an account, clicking "I agree" (or similar), installing the app, or otherwise accessing or using the Service, you represent and warrant that:
- You have read, understood, and agree to be bound by these Terms in full;
- You have read and acknowledge our Privacy Policy (https://twellie.com/privacy), which is incorporated into these Terms by reference;
- You have read and acknowledge our Acceptable Use Policy (https://twellie.com/aup), which is incorporated into these Terms by reference;
- You have read and acknowledge our AI Output Disclaimer (https://twellie.com/disclaimer), which is incorporated into these Terms by reference;
- You have the legal capacity and authority to enter into these Terms, and, if entering on behalf of a company or other legal entity, that you have authority to bind that entity.
If you do not agree with any part of these Terms, do not access or use the Service. Your only remedy for any disagreement is to not use the Service.
1.3 Changes to the Service
The Service is continually evolving. We may add, modify, remove, or discontinue features, pricing plans, third-party integrations, Reports, content, or any other aspect of the Service at any time without liability to you. We will use reasonable efforts to notify you of material changes that reduce the Service's functionality, but are not obligated to do so.
1.4 Reliance
You acknowledge that you have not relied on any statement, promise, representation, or warranty made or given by us or on our behalf that is not set out in these Terms.
2. Definitions
"Account" means the user account you create to access the Service.
"Affiliate" means any entity controlling, controlled by, or under common control with the Company.
"AI Output" or "AI-Generated Content" means any text, number, score, valuation, recommendation, analysis, summary, report, or other output produced in whole or in part by algorithmic, machine-learning, or artificial-intelligence systems, whether operated by the Company or a third-party provider.
"Content" means all information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials.
"Free Plan" means the version of the Service made available at no cost, subject to monthly report limits and other restrictions.
"Paid Product" means any paid Twellie product, including the current one-time per-property Report checkout, a manual multiple-property invoice, or any clearly disclosed future recurring subscription.
"Report" means the property-research output actually shown for a submitted address. Depending on verified source coverage and the evidence gate, it may include provider-recorded property facts and history, comparable-sale evidence, a FEMA flood screen, ownership-cost assumptions, photo observations, due-diligence prompts, and conditional price guidance. A Report identifies unavailable categories rather than silently filling them with estimates.
"Subject Property" means a residential real-estate property submitted to the Service for analysis.
"User Content" means any content you upload, submit, enter, or otherwise provide to the Service, including property addresses, photographs, documents, buyer profiles, notes, and messages.
3. Eligibility and Account Registration
3.1 Age and Legal Capacity
You must be at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is higher) and have the legal capacity to enter into binding contracts to use the Service. The Service is not intended for individuals under 18, and we do not knowingly collect information from children. If we discover that a User is under 18, we will terminate their Account and delete their data.
3.2 Geographic Availability
The Service is currently designed for, and offered to, residents of the United States and properties located in the United States. We may restrict access from other jurisdictions at our sole discretion. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
3.3 Account Registration
To access most features, you must register for an Account. You agree to:
- Provide accurate, current, and complete information during registration and to keep that information updated;
- Maintain the security of your Account credentials, including your password, and not share them with any other person;
- Be solely responsible for all activity that occurs under your Account, whether or not authorized by you;
- Notify us immediately of any unauthorized access to or use of your Account at security@twellie.com;
- Not create more than one Account for yourself, create an Account on behalf of anyone other than yourself, or create an Account using false or misleading information.
3.4 Account Sharing and Multi-User Access
Accounts are personal and non-transferable. You may not sell, lease, sublicense, share, transfer, or otherwise make your Account available to any third party. We reserve the right to suspend Accounts that appear to be shared among multiple individuals.
3.5 Identity Verification
We reserve the right, but have no obligation, to verify your identity at any time. We may require you to provide additional information (such as proof of address or government-issued identification) to access certain features. Failure to provide requested verification may result in suspension or termination of your Account.
4. Description of the Service
4.1 What We Do
Twellie combines buyer inputs with traceable third-party and government-source evidence to generate residential-property research. A Report may include:
- Exact-address identity and listing facts from the identified provider record;
- Provider-recorded listing, price, tax, and prior-sale events, expressly not a title chain;
- Qualified comparable sales with source links, distance, recency, and adjustment notes;
- Census geocoding, a FEMA flood-map screen, and Freddie Mac rate assumptions when available;
- Photo observations that are not an inspection;
- Ownership-cost assumptions, evidence gaps, and a buyer due-diligence plan;
- Conditional value or offer ceilings only when the evidence, provenance, and calibration gates all pass.
The current Service does not promise verified school, crime, walkability, climate, permit, zoning, lien, title, or county-recorder coverage. Those categories are shown as unavailable unless a traceable supported source is present. Model-derived price guidance is withheld when the decision gate does not pass.
4.2 What We Are Not
Twellie is a software information service. We are NOT, and nothing in the Service should be interpreted as, any of the following:
- A licensed real-estate broker, agent, or salesperson;
- A licensed real-estate appraiser;
- A licensed home inspector, general contractor, or building engineer;
- A licensed attorney or law firm;
- A registered investment adviser, broker-dealer, or financial planner;
- A mortgage lender, loan originator, or credit counselor;
- An insurance broker, agent, or advisor;
- A title company, escrow agent, or closing service;
- A tax advisor, enrolled agent, or CPA.
We do not provide legal, financial, investment, insurance, appraisal, inspection, or tax advice. Reports are information, not advice. You bear sole responsibility for any decision you make based on the Service, including whether to buy, sell, rent, invest in, renovate, insure, or avoid any property.
4.3 Data Sources
The current Service can use buyer-submitted information and photographs, provider-mediated listing/property records, U.S. Census Bureau geocoding, FEMA flood-map data, and Freddie Mac mortgage-rate data. Each Report identifies the sources actually used, retrieval time where available, and material gaps. We may add other properly licensed sources later, but their possible future availability is not a promise that they are present now. We do not guarantee the accuracy, completeness, identity match, or currentness of third-party data.
4.4 Beta Features
From time to time we may offer Beta Features — pre-release or experimental functionality. Beta Features are provided "as-is" and "as-available" with no warranty of any kind. We may change or withdraw Beta Features at any time.
4.5 Service Availability
We strive for high availability but do not guarantee that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Planned maintenance, emergency maintenance, third-party outages, denial-of-service attacks, and other events may cause downtime.
5. AI Analysis Disclaimer — READ CAREFULLY
THIS SECTION IS MATERIAL. By using the Service, you explicitly acknowledge and agree to every statement in this Section 5.
5.1 AI Outputs Are Estimates, Not Valuations
Every Report is a computer-generated estimate based on publicly available data, third-party data feeds, photographs, and algorithms. Reports are NOT:
- A Uniform Standards of Professional Appraisal Practice (USPAP) appraisal;
- A broker price opinion (BPO) or comparative market analysis (CMA) performed by a licensed agent;
- A professional home inspection;
- A title search or title insurance commitment;
- Legal advice, financial advice, or investment advice;
- A guarantee or warranty of any future market value, rental income, appreciation, risk, condition, or return on investment.
No Twellie Report may be used for mortgage underwriting, insurance underwriting, tax appeals, judicial proceedings, bank collateral valuation, or any other purpose requiring a licensed valuation.
5.2 AI Can Be Wrong
Artificial intelligence and machine learning systems make errors — sometimes serious ones. Reports may contain:
- Valuations that are materially too high or too low, including by tens or hundreds of thousands of dollars;
- Incorrect or outdated property facts (square footage, bedrooms, year built, lot size, permits, ownership, taxes, liens);
- Hallucinated information — plausible-sounding text with no factual basis;
- Miscategorized or missing comparable sales, including inappropriate comps, foreclosures treated as arm's-length sales, or family-transfer sales counted;
- Inaccurate photo interpretations (e.g. labeling a kitchen as "recently renovated" when it is not);
- Incorrect risk assessments (e.g. understating flood, wildfire, earthquake, or environmental risks);
- Incomplete legal information (undisclosed liens, easements, zoning issues, code violations, unpermitted work);
- Outdated neighborhood data (stale school ratings, prior-year crime data, lagging market momentum);
- Wrong offer-strategy recommendations that could cause you to overpay or miss out on a property.
5.3 Your Duty to Verify
You are solely responsible for independently verifying every material fact and figure in any Report before taking any action. At a minimum, before relying on a Report for a purchase, sale, rental, insurance, or investment decision, you must:
- Retain a licensed real-estate agent to conduct a comparative market analysis;
- Retain a licensed appraiser to perform a USPAP-compliant appraisal if precise value matters (e.g. mortgage, litigation, tax);
- Retain a licensed home inspector, and specialized inspectors (structural, pest, mold, radon, sewer, roof, HVAC, electrical) as appropriate;
- Review the actual title commitment and any survey from a licensed title company;
- Consult a real-estate attorney licensed in the relevant jurisdiction for contract review and title issues;
- Consult a licensed insurance agent for flood, hazard, and liability insurance quotes;
- Consult a CPA or tax advisor for the tax implications of your transaction;
- Verify school, crime, and neighborhood data with the relevant authorities.
5.4 No Fiduciary Duty
The Company owes you no fiduciary duty. We are not your agent, broker, adviser, fiduciary, or representative. Nothing in the Service creates an agency, fiduciary, employment, partnership, or joint-venture relationship between you and the Company.
5.5 Market Conditions Change
Real-estate markets change rapidly. A Report reflects conditions at a single moment. Interest rates, comparable sales, inventory, demand, and demographics can shift meaningfully within days. A Report may be out-of-date by the time you read it.
5.6 Photographs and Condition
Photo-based condition assessments rely on visible features in 2D images. They cannot assess:
- Structural issues, foundation problems, or settlement;
- Electrical wiring, plumbing, or HVAC adequacy;
- Hidden water intrusion, mold, or rot;
- Pest infestations, termites, or wood-destroying organisms;
- Radon, lead, asbestos, or other environmental hazards;
- Code compliance, permit status, or unpermitted work;
- Functional obsolescence or layout problems;
- Noise, odor, or other environmental factors;
- Neighborhood nuisances not visible in the frame.
Photographs lie. Sellers and agents stage, enhance, wide-angle-distort, and otherwise present homes favorably. Any photo-derived assessment may be off by wide margins.
5.7 Financial Projections Are Estimates
Mortgage payment, cash-flow, cap-rate, cash-on-cash return, rent-vs-buy, appreciation, and other financial projections in Reports are illustrative estimates only. Actual results will differ, often materially, due to interest-rate changes, tax-rate changes, insurance costs, maintenance, vacancy, repairs, HOA assessments, market shifts, personal circumstances, and factors outside our control. Past performance is not indicative of future results. No projected value, return, or outcome is guaranteed.
5.8 No Real-Estate, Legal, Financial, or Professional Advice
Nothing in the Service constitutes real-estate brokerage services, legal advice, financial advice, investment advice, insurance advice, tax advice, or any other professional advice. Any information, recommendation, or suggestion is for general informational purposes only. Do not act or refrain from acting based on any Report without first seeking advice from a qualified, licensed professional.
5.9 Prohibited Regulated Uses
You shall not use the Service, or any Report, for:
- Mortgage underwriting or lending decisions (violates Dodd-Frank and appraiser-independence rules);
- Automated Valuation Model (AVM) submissions under federal or state AVM-quality rules;
- Eminent-domain, tax-appeal, divorce, probate, or litigation valuations requiring licensed appraisal;
- Insurance underwriting;
- Investment securities offerings (Reg D / Reg A / public offerings where USPAP valuation is required);
- Financial statements for banks, creditors, or the IRS;
- Any purpose where federal, state, or local law requires a licensed appraisal or professional opinion.
5.10 Acknowledgement
You acknowledge you have read and understood this Section 5 in full. You agree that these disclosures are material to our decision to make the Service available to you, and that you would not be permitted to use the Service without agreeing to them.
6. Fees, Checkout, and Billing
6.1 Current Self-Serve Product
The current self-serve paid product is a per-property Report. Unless the pricing page says otherwise at checkout, the self-serve price is $50 USD for one address. A paid per-property checkout unlocks the Report and related workspace tools for that address.
Free usage, preview usage, manual invoice options, and any future team or subscription offerings may have separate limits. Current pricing and feature descriptions are published at https://twellie.com/pricing and are incorporated into these Terms by reference. We may change features, limits, and pricing at any time, but a completed one-time checkout is governed by the price shown at checkout.
6.2 One-Time Stripe Checkout Authorization
By completing a one-time checkout, you authorize the Company and its payment processor (Stripe, Inc.) to charge the payment method you provide for the amount shown at checkout. A per-property checkout is not a recurring subscription unless the checkout page clearly says it is recurring before you pay.
Stripe may update card details automatically via card network account updaters where supported for fraud prevention, receipts, and payment support. The Company does not receive your full card number.
6.3 Taxes
Prices displayed on the Service are exclusive of applicable sales, use, value-added, excise, or similar taxes unless expressly stated otherwise. You are responsible for all such taxes except for taxes based on our net income.
6.4 Price Changes
We may change future pricing at any time. Price changes do not retroactively change a one-time charge you already completed.
6.5 Free Previews and Promotional Offers
We may offer free previews, trials, or promotional pricing. Unless otherwise stated:
- One free preview or trial per User and per payment method;
- We may end or modify any promotion at any time;
- If you have received a discount, credit, or free preview in an abusive pattern (multiple accounts, friends/family signups for you, automation, etc.) we may revoke the benefit and restrict access.
6.6 Usage Limits and Overages
Free and preview usage may include monthly or daily Report limits. Once a free allowance is exhausted, you may:
- Wait until the allowance resets;
- Purchase a per-property Report if offered;
- Contact support for a manual multiple-property invoice.
We do not issue cash value for unused free allowances or promotional credits.
6.7 Chargebacks and Disputes
If you dispute a charge with your card issuer (a "chargeback"):
- Your Account may be immediately suspended pending resolution;
- If the chargeback is found in our favor, we may bar you from creating future Accounts and may recover our costs;
- Filing a chargeback instead of first contacting us at billing@twellie.com is a material breach of these Terms.
7. Refunds and Cancellations
7.1 One-Time Purchases
Per-property Reports are one-time purchases. There is no consumer subscription to cancel for a completed per-property checkout. You may still delete your Account and data as described in our Privacy Policy.
7.2 Refund Policy
If checkout succeeds but the Report fails to generate, the wrong address is charged, you are charged twice, or there is another clear billing error, email billing@twellie.com and we will make it right by refunding, re-running, or unlocking the correct address.
Successfully generated Reports are reviewed case by case. We are not required to issue refunds solely because:
- You disagree with a valuation, confidence band, recommendation, or model output (see Section 5);
- You decide not to use the Report after it was generated;
- Your needs, personal circumstances, or the real-estate market changed;
- Temporary outages do not materially prevent access to the purchased Report.
Nothing in this Section limits rights you may have under applicable consumer-protection law.
7.3 Future Subscriptions
If the Company later offers a clearly disclosed recurring subscription, the checkout page will identify the renewal period and cancellation process before you pay. Those subscription-specific terms will apply only to users who affirmatively purchase that recurring product.
8. User Content and License Grant
8.1 Your Content
You retain all right, title, and interest in and to the content you submit to the Service, including property addresses, photographs, documents, notes, buyer profiles, and messages ("User Content"). We do not claim ownership of User Content.
8.2 License to the Company
To provide the Service you must grant us certain rights in your User Content. You hereby grant the Company a worldwide, royalty-free, non-exclusive, sublicensable, transferable license to:
- Host, store, reproduce, distribute, modify, adapt, publish, translate, and display your User Content;
- Combine your User Content with other data to generate Reports;
- Use de-identified and aggregated derivatives of your User Content to improve the Service, train models, publish anonymized market insights, and develop new products;
- Share your User Content with our service providers for the limited purpose of operating the Service.
This license survives termination of your Account for the limited purpose of retaining and using de-identified, aggregated data as described above, which is no longer attributable to you.
8.3 Representations about User Content
By submitting User Content you represent and warrant that:
- You own or have obtained all necessary rights to grant the license in Section 8.2, including any rights of third parties appearing in photographs (e.g. co-owners, tenants, neighbors);
- Your User Content does not violate any law or these Terms and does not infringe any third-party right (including copyright, trademark, publicity, or privacy);
- Your User Content is not false or misleading in a way designed to manipulate the Service, other users, or any Report;
- You have the right to submit the Subject Property's address and any associated photographs for analysis.
8.4 Our Use of AI Outputs
Reports generated by the Service are owned by the Company. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to view, download, and print your own Reports for your personal (or, in the case of a business account, internal business) use in considering a specific real-estate transaction.
You may not:
- Resell, relicense, redistribute, or commercially exploit any Report;
- Use any Report to train a machine-learning model that competes with Twellie;
- Strip attribution, disclaimers, or watermarks from any Report;
- Reproduce or publish Reports publicly without our prior written consent.
8.5 DMCA Takedown
We respond to valid notices under the Digital Millennium Copyright Act ("DMCA"). If you believe your copyrighted work has been infringed through the Service, send a notice to dmca@twellie.com containing the information required by 17 U.S.C. § 512(c)(3). We may terminate accounts of repeat infringers.
9. Acceptable Use
Our Acceptable Use Policy (https://twellie.com/aup) is part of these Terms. Without limiting that Policy, you agree not to:
9.1 Security and Integrity
- Attempt to gain unauthorized access to the Service, other Accounts, or our infrastructure;
- Probe, scan, or test the vulnerability of any system or network without our prior written consent;
- Circumvent, disable, or interfere with security-related features;
- Introduce malware, viruses, trojans, worms, logic bombs, or other harmful code;
- Engage in denial-of-service or similar disruptive activity.
9.2 Automated Access
- Scrape, crawl, harvest, or index the Service or Reports using any automated means;
- Use the Service to build a competing dataset, product, or model;
- Use the Service in a manner that exceeds reasonable volume limits;
- Use headless browsers or residential-IP rotation to evade rate limits.
9.3 Content Restrictions
Do not submit, generate, or attempt to generate through the Service any content that:
- Is unlawful, threatening, harassing, defamatory, hateful, obscene, invasive of privacy, or otherwise objectionable;
- Violates any person's intellectual property, privacy, or publicity rights;
- Contains personal information of a third party without their consent;
- Attempts to manipulate the AI into producing outputs that bypass our safeguards, reveal our prompts, or violate these Terms.
9.4 Prohibited Regulated Uses
Reiterating Section 5.9: do not use the Service or any Report for mortgage underwriting, appraiser-independence-regulated valuations, tax appeals, litigation, insurance underwriting, securities offerings, or any other use requiring licensed professional valuation.
9.5 Abuse Reporting
Report abuse or other violations to abuse@twellie.com.
10. Intellectual Property Rights
10.1 Ownership
The Service, including all software, source code, algorithms, models, databases, Reports, trademarks, logos, designs, text, graphics, and other materials (excluding User Content), is owned by the Company or its licensors and is protected by U.S. and international copyright, trademark, trade-secret, and other intellectual-property laws. All rights not expressly granted to you are reserved.
10.2 Limited License to Users
Subject to your compliance with these Terms and payment of all applicable fees, the Company grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service solely for your personal (or internal business, if a business account) use in connection with residential real-estate decisions you are personally considering.
10.3 Trademarks
"Twellie," the Twellie logo, and all product and feature names are trademarks of the Company or its licensors. You may not use them without our prior written consent. All other trademarks appearing in the Service belong to their respective owners.
10.4 Feedback
If you submit ideas, suggestions, feature requests, bug reports, or other feedback ("Feedback") about the Service, you hereby grant the Company a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, modify, and exploit the Feedback for any purpose, without any obligation or compensation to you.
11. Third-Party Services and Data
11.1 Third-Party Providers
The Service integrates with third-party services, including but not limited to:
- Supabase (authentication, database, storage);
- Stripe, Inc. (payment processing);
- AI business API providers (model inference and synthesis providers);
- Resend (transactional email);
- Sentry (error monitoring);
- Meta / Facebook (analytics and advertising);
- Google Analytics 4 (analytics);
- OpenStreetMap, Leaflet, Plotly (mapping and visualization);
- FEMA, U.S. Census Bureau, Federal Reserve FRED, USGS, EPA (government data);
- RentCast (provider-reported property, listing, tax/assessment, and comparable-sale records); and
- Other property-data vendors only if separately activated and disclosed.
RentCast is the designated production property-data provider. Access to an API does not by itself establish every commercial display, storage, AI-processing, or derivative-use right the Service may require. The Service will not start a paid property-report checkout unless the Company has reviewed and recorded the required rights for every production property-data source and the applicable accuracy gates pass. No legacy scraper is configured as a production fallback.
Your use of third-party services is governed by their respective terms and privacy policies. The Company is not responsible for third-party services' availability, accuracy, privacy practices, or content.
11.2 Third-Party Links
Reports and the Service may contain links to third-party websites (e.g. GreatSchools, FEMA flood maps). We provide these for convenience only; we do not endorse and are not responsible for third-party content.
11.3 Data Source Risk
Third-party data may be inaccurate, out-of-date, or incomplete. We do not guarantee, warrant, or make any representation regarding third-party data. Reports depend on third-party inputs and inherit their limitations.
11.4 Service Provider Outages
Third-party outages (Supabase, Stripe, AI providers, etc.) may cause Service disruptions. We are not liable for such disruptions, though we will make commercially reasonable efforts to restore Service.
12. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy (https://twellie.com/privacy), which describes what information we collect, how we use it, with whom we share it, and your rights regarding your personal information. By using the Service you consent to our privacy practices described there.
13. Disclaimers of Warranties
13.1 AS-IS Provision
THE SERVICE, INCLUDING ALL REPORTS, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. - UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION;
- FREEDOM FROM VIRUSES OR OTHER HARMFUL COMPONENTS;
- THAT ANY PROPERTY, VALUATION, PROJECTION, OR RECOMMENDATION WILL PROVE ACCURATE, PROFITABLE, OR SUITED TO YOUR NEEDS;
- THAT THE SERVICE WILL MEET ANY PARTICULAR REQUIREMENT;
- AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.
13.2 No Endorsement
No advice or information obtained from the Service creates any warranty not expressly stated in these Terms.
13.3 Jurisdiction-Specific Carve-Outs
Some jurisdictions do not allow disclaimer of certain implied warranties, so some or all of the above may not apply to you.
13.4 AI Specifically
Without limiting the above, the Company makes no warranty or representation regarding any AI Output, including accuracy, reliability, timeliness, non-infringement, suitability for a particular purpose, fitness for any regulated use, or that any AI Output will be free of hallucinations, biases, errors, or omissions.
14. Limitation of Liability
14.1 Exclusion of Indirect Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE HOMEAI PARTIES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, DATA, OR USE);
- DAMAGES ARISING FROM ANY REAL-ESTATE TRANSACTION YOU DO OR DO NOT UNDERTAKE, INCLUDING OVERPAYMENT, UNDERSALE, FAILED FINANCING, MISSED OPPORTUNITIES, COST OF REPAIRS, INSURANCE SHORTFALLS, TAX LIABILITIES, LOST RENT, OR VACANCY;
- DAMAGES ARISING FROM AI ERRORS, HALLUCINATIONS, OMISSIONS, OR INACCURATE OUTPUTS;
- DAMAGES ARISING FROM RELIANCE ON ANY REPORT OR RECOMMENDATION;
- DAMAGES ARISING FROM THIRD-PARTY DATA, THIRD-PARTY LINKS, OR THIRD-PARTY SERVICE INTERRUPTIONS;
- DAMAGES ARISING FROM SERVICE INTERRUPTIONS, OUTAGES, OR SECURITY INCIDENTS;
- DAMAGES ARISING FROM USER CONTENT OR FROM THE ACTIONS OF OTHER USERS OR THIRD PARTIES;
WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHER LEGAL THEORY, AND WHETHER OR NOT HOMEAI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
14.2 Aggregate Cap
WITHOUT LIMITING SECTION 14.1, THE HOMEAI PARTIES' TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU ACTUALLY PAID HOMEAI IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
14.3 Essential Basis of the Bargain
You acknowledge that (a) the Company could not provide the Service without these limitations, (b) the fees we charge reflect the allocation of risk reflected in these limitations, and (c) these limitations form an essential basis of the bargain.
14.4 Consumer-Rights Jurisdictions
Some states do not allow the exclusion or limitation of incidental or consequential damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
14.5 Claim Filing Deadline
Any claim arising out of or relating to the Service or these Terms must be filed within ONE (1) YEAR after the cause of action accrues, or it is permanently barred.
15. Indemnification
15.1 Your Indemnity to the Company
You agree to indemnify, defend, and hold harmless the Company, its Affiliates, and their respective officers, managers, members, employees, contractors, agents, successors, and assigns from and against any and all claims, demands, actions, proceedings, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your access to or use of the Service;
- Your User Content;
- Your violation of these Terms;
- Your violation of any law or regulation;
- Your violation of any third-party right (including intellectual-property, privacy, and publicity rights);
- Any real-estate transaction you pursued, declined, or declined to investigate based in whole or in part on a Report;
- Your reliance on any AI Output;
- Any willful misconduct or gross negligence by you.
15.2 Our Control
We may, at our option, assume exclusive control of the defense and settlement of any matter subject to indemnification. You will cooperate fully with our defense, and you will not settle any matter without our prior written consent.
16. Account Suspension and Termination
16.1 By You
You may delete your Account at any time via https://twellie.com/dashboard.
16.2 By the Company
We may suspend or terminate your Account, in whole or in part, with or without notice, at our sole discretion, including for:
- Breach of these Terms or our Acceptable Use Policy;
- Fraud, abuse, scraping, security violations, or excessive usage;
- Chargebacks or non-payment;
- A request from law enforcement, government, or court order;
- Extended inactivity (no login for 12+ months, following email notice);
- Risk to our Service, our infrastructure, or other users;
- Business reasons, including discontinuation of the Service.
16.3 Effect of Termination
Upon termination:
- Your license to use the Service ends immediately;
- We may retain your data for legal-hold, billing, or regulatory purposes;
- We will not refund any pre-paid fees, except as required by law;
- Sections 5, 8, 10, 11.3, 13, 14, 15, 17, 18, and 22 survive termination.
17. Dispute Resolution, Arbitration, and Class-Action Waiver
17.1 Informal Resolution First
Before filing any claim, you agree to first contact us at legal@twellie.com with a written description of the dispute and a proposed resolution. We will attempt to resolve the dispute informally within sixty (60) days.
17.2 Binding Individual Arbitration
IF INFORMAL RESOLUTION FAILS, YOU AND HOMEAI AGREE TO RESOLVE ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE BY BINDING INDIVIDUAL ARBITRATION, except as provided in Section 17.6.
17.3 Arbitration Rules and Forum
- Arbitration administered by JAMS under its Consumer Minimum Standards and Streamlined Arbitration Rules;
- Held in Casper, Wyoming, except that for claims under US$10,000 you may elect telephonic or video arbitration;
- Conducted in English;
- Arbitrator's decision is final and binding, subject only to review under the Federal Arbitration Act.
17.4 Arbitration Fees
We will pay the filing and administrative fees in excess of what you would pay to file a claim in court, up to US$5,000, except that you will pay your share if the arbitrator finds your claim was brought in bad faith.
17.5 CLASS-ACTION WAIVER
YOU AND HOMEAI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If this class-action waiver is held unenforceable, then the entirety of Section 17 is null and void, but the remainder of these Terms survives.
17.6 Exceptions
- Either party may bring claims in small-claims court if they qualify;
- Either party may seek injunctive or equitable relief in court to stop unauthorized use of intellectual property, confidential information, or security breaches;
- Claims may be brought in court if required by applicable non-waivable consumer law.
17.7 Opt-Out Right
You may opt out of the arbitration provision and class-action waiver by emailing us at legal@twellie.com within thirty (30) days of creating your Account with the subject line "Arbitration Opt-Out" and stating your full name and email. Opt-out applies only to you.
17.8 Survival
This Section 17 survives termination of these Terms and of your Account.
18. Governing Law and Venue
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, except that (a) the Federal Arbitration Act governs the interpretation and enforcement of Section 17, and (b) mandatory consumer-protection laws of your state of residence may apply where they cannot be overridden by contract.
Subject to Section 17, the exclusive jurisdiction and venue for any action not subject to arbitration is the state and federal courts located in Natrona County, Wyoming.
19. Changes to These Terms
We may amend these Terms from time to time. If we make a material change we will:
- Post the revised Terms at https://twellie.com/terms with a new "Last Updated" date;
- Send a notification to the email associated with your Account at least thirty (30) days before the change takes effect, where feasible;
- Require affirmative re-acceptance where required by law.
Continued use of the Service after the effective date constitutes acceptance of the revised Terms. Non-material changes (typo corrections, clarifications, new plan names) may take effect immediately without prior notice.
20. Notices and Electronic Communications
20.1 Notices to You
You consent to receive notices by email at the address associated with your Account, by in-app notifications, or by posting on the Service. Electronic notices satisfy any legal requirement for written notice.
20.2 Notices to the Company
Legal notices to the Company must be sent by email to legal@twellie.com AND by overnight courier to EnglishAidol LLC, Attn: Legal Department, 5830 E 2nd St, Ste 7000 #29281, Casper, WY 82609, United States.
20.3 Marketing Communications
By creating an Account you consent to receive transactional emails. You may opt out of marketing emails via the unsubscribe link.
20.4 SMS and Phone
If you provide a phone number, you consent to receive SMS and phone communications related to the Service. Message and data rates may apply. Reply STOP to opt out.
21. Export Compliance and Sanctions
You represent and warrant that you are not located in, a national of, or ordinarily resident in any country subject to a U.S. embargo (including Cuba, Iran, North Korea, Syria, and the Crimea/Donetsk/Luhansk regions of Ukraine), and are not on any U.S. government restricted-party list. You will not export, re-export, or transfer the Service to any embargoed country or restricted party.
22. General Provisions
22.1 Entire Agreement
These Terms, together with the Privacy Policy, Acceptable Use Policy, AI Output Disclaimer, and any order form or written agreement signed by both parties, constitute the entire agreement between you and the Company regarding the Service.
22.2 Severability
If any provision of these Terms is held invalid or unenforceable, the provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
22.3 Waiver
Failure to enforce any provision is not a waiver. Any waiver must be in writing and signed by the waiving party.
22.4 Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
22.5 Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.
22.6 Force Majeure
Neither party is liable for any delay or failure to perform caused by events beyond its reasonable control, including natural disasters, war, terrorism, civil unrest, pandemics, labor disputes, power failures, internet outages, third-party service outages, government actions, and AI model provider outages.
22.7 Independent Contractors
You and the Company are independent contractors. No partnership, agency, joint venture, or employment relationship is created.
22.8 Language
These Terms are written in English. Any translation is provided for convenience; in case of conflict the English version controls.
22.9 Interpretation
Ambiguities will not be construed against the drafter.
22.10 Electronic Signatures
These Terms may be accepted electronically. You agree that your electronic acceptance has the same effect as your handwritten signature.

24. State-Specific Provisions
24.1 California Residents
Civil Code § 1789.3. California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or (800) 952-5210.
Recurring Billing Disclosure. The current self-serve per-property Report checkout is a one-time purchase and does not automatically renew. If the Company offers a recurring subscription in the future, the checkout page will disclose renewal terms before payment. See Sections 6 and 7.
24.2 New York Residents
New York real-estate-license law prohibits unlicensed persons from holding themselves out as providing appraisal, brokerage, or agent services. The Company does not provide such services through Twellie. Reports are informational only and are not an appraisal, CMA, BPO, or any licensed opinion.
24.3 Texas Residents
The Company is not a licensed real-estate broker, sales agent, appraiser, or inspector in Texas or any other state. Reports do not constitute brokerage, appraisal, or inspection services.
24.4 Florida Residents
No provision of these Terms is intended to limit or waive rights that cannot be limited or waived under Florida's Deceptive and Unfair Trade Practices Act.
25. API Terms (If Available)
If the Company makes a Twellie API available to you (today, only via a separately executed enterprise agreement; future self-serve API tiers would also be subject to these Terms):
25.1 License Grant
A limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access the API solely for purposes authorised by a separate API agreement or by published API documentation.
25.2 API Keys
API keys are confidential credentials. You must: - Keep keys secret; never commit keys to public repositories, ship them in mobile-app binaries, or expose them in client-side JavaScript; - Rotate keys immediately upon suspected compromise; - Tie one set of keys to one identified entity; do not share keys across organisations.
25.3 Rate Limits and Fair Use
API usage is subject to per-key rate limits, per-endpoint quotas, and overall platform fair-use. We may: - Return 429 Too Many Requests or 403 Forbidden where limits are breached; - Contact you before taking restrictive action where feasible; - Suspend keys used in ways that disrupt the Service for other users.
25.4 Attribution
If you surface API outputs in a user-facing product, include the attribution string "Powered by Twellie" at a visible location, unless a paid agreement expressly waives this requirement.
25.5 No Scraping or Resale
The API may not be used to scrape the web application or circumvent billing. API outputs may not be resold or re-licensed except as expressly permitted in a written agreement.
25.6 No SLA Without Contract
Self-serve API access is offered without uptime, latency, or availability guarantees. Enterprise customers with a written agreement receive SLAs as specified therein.
26. Beta Features
From time to time, the Company may offer experimental features ("Beta Features") marked as "alpha," "beta," "preview," "early access," or similar. Beta Features:
- Are provided "as-is" and "as-available" with no warranty beyond the general Section 13 disclaimers;
- May change or be removed at any time without notice;
- May produce unreliable or unexpected results;
- Are not supported at the same level as generally-available features;
- May be subject to separate Beta Terms displayed when you opt in.
Any data generated with Beta Features may be deleted when the Beta Feature is withdrawn, unless we indicate otherwise.
27. Referral Program
If the Company operates a referral program — where existing users invite friends and earn service credits:
- One referral credit per new paying subscriber (uniquely identified by email AND payment method).
- Credits have no cash value and are not transferable or redeemable for cash.
- Credits expire twelve (12) months after issue unless extended.
- The Company reserves the right to void credits earned through fraud, self-referral, multi-account rings, or incentivised sign-ups that would violate FTC endorsement rules.
- Referral emails/messages must accurately describe the Service and must not make false or misleading claims. The referring user is responsible for their own compliance with CAN-SPAM, TCPA, and similar laws.
- The Company may modify or terminate the referral program at any time; outstanding credits remain valid through their expiry.
28. Communications and Marketing Preferences
By creating an Account, you consent to receive:
- Transactional emails (receipts, security alerts, report-ready, password reset, legal notices) — these are required to operate your Account and cannot be opted out of while the Account is active;
- Service announcements (feature releases, scheduled maintenance, material changes to Terms or Privacy) — opt-out available but not recommended;
- Marketing emails (product tips, offers, newsletters) — opt-out at any time via the unsubscribe link in any marketing email.
If you provide a phone number and affirmatively opt in: - SMS support or notifications may be sent. Reply STOP to opt out. Message and data rates apply.
We honour the CAN-SPAM Act (15 U.S.C. §§ 7701-7713), TCPA (47 U.S.C. § 227 with FCC rules), and the CASL (Canada's Anti-Spam Legislation) where applicable. If you received a marketing email you did not opt in to, email privacy@twellie.com and we will investigate.
29. Accessibility
Twellie strives to make the Service usable by people of all abilities. Our current commitments are described in our Accessibility Statement.
If a specific accessibility barrier prevents you from using the Service, email accessibility@twellie.com — we will acknowledge within three business days and work to provide an accessible alternative.
30. Special Terms for Professional Users
If you use the Service as a licensed real-estate professional (broker, agent, appraiser, lender, attorney, inspector, insurance agent, institutional investor, iBuyer, or similar), you are a Professional User and are subject to the additional terms in our Professional User Addendum, which is incorporated into these Terms by reference. Professional Users assume heightened responsibilities, including not submitting Reports as licensed valuations and indemnifying the Company against client claims that arise from professional use.
